OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from falling or collapsing wooden trusses.  At a worksite located at 3271 Bay Settlement Road in Green Bay, Wisconsin;  On or about September 27, 2021, employees engaged in nailing bottom chords to the top plate of the wall and a truss spacer on the top chord of the trusses on a one-story new residential site were exposed to struck-by hazards when walking on and between trusses that had not been braced to resist out-of-plane buckling, leaning, and/or collapse due to the lack of top chord, web member, and bottom chord bracing.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  At a worksite located at 3271 Bay Settlement Road in Green Bay, Wisconsin;  On or about September 27, 2021, employees engaged in setting trusses on a new one-story residential construction were exposed to injuries from falling approximately 11 feet 1 inch off the east side of the structure, and approximately 17 feet 8 inches off the west side of the structure without utilizing fall protection equipment.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.

At a worksite located at 3271 Bay Settlement Road in Green Bay, Wisconsin;  On or about September 27, 2021, employees were observed using the top step of a 6-foot folding stepladder to egress the top plate of the wall on a new residential construction.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  At a worksite located at 3271 Bay Settlement Road in Green Bay, Wisconsin;  On or about September 27, 2021, an employee was rigging trusses using a single-point sling and guiding a suspended load without utilizing head protection, exposing the employee to struck-by injuries from the load.
