29 CFR 1926.501(c): When employees were exposed to falling objects the employer did not implement measures to prevent objects from falling from higher levels as set forth in (c)(1)-(3) of this section:  a)  21 John Cross Road, Bedford Corners, NY:   On or about 9/29/21, employees were exposed to the hazard of getting struck by a tree that was being  felled and the employer did not implement the measures as required by the standard.  Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a)  21 John Cross Road, Bedford Corners, NY - Back of the House:   On or about 9/29/21, employees performing masonry and related work were exposed to the hazard of getting struck by a tree that was being  felled in the backyard and the employer did not instruct each employee in the recognition and avoidance of this hazard.

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): 29 CFR  1910.1200(g)(1):  Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:   a) 21 John Cross Road, Bedford Corners, NY:    An employee manually mixed bags of Quickrete 5000 Concrete Mix (portland cement) and a bag of Quickrete Mason Mix (portland cement) in a wheelbarrow and another employee used this mixed material to make two steps leading to an outside door and the employer did not develop and implement a written hazard communication program;  on or about 9/29/21.  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    a) 21 John Cross Road, Bedford Corners, NY:    An employee manually mixed bags of Quickrete 5000 Concrete Mix (portland cement) and a bag of Quickrete Mason Mix (portland cement) in a wheelbarrow and another employee used this mixed material to make two steps leading to an outside door and the employer training did not include an explanation of the  safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information;  on or about  9/29/21.  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.
