29 CFR  1960.9: Employer neglected its supervisory authority by not providing employees a place of employment that was free of recognized hazards that were causing or likely to cause serious physical harm or death. Employer also failed to comply with the occupational safety and health standards applicable to their agency and with all rules, regulations, and orders issued by the head of the agency with respect to the agency occupational safety and health program.   a) PROCESSING AREA - On or about November 16, 2021, and at times prior thereto, facility management did not ensure that all uniformed personnel, regardless of vaccine status, wore N95 respirators in processing, detention, and transportation settings as ordered by the Chief of U.S. Border Patrol in its memo dated September 7, 2021.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) PROCESSING CENTER: On or about December 15, 2021, employees donned an N95 filtering facepiece respirator during fit testing but were medically evaluated to wear a powered air purifying respirator (PAPR).

29 CFR  1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  (a) PROCESSING: On or about November 16, 2021, an employee who was required to wear an N95 respirator for protection against SARS-CoV-2 virus, had facial hair that came between the sealing surface of the respirator and face.
