29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Gray Duck Builders, LLC at 4225 Interlachen Trail, Sioux Falls, SD 57106:  On or about and at times prior to October 4, 2021, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards as a result of conducting framing activities without the use of a fall protection system, fall hazards associated with improper use of ladders, and lack of training. This condition exposed employees to a variety of hazards identified on site.      Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) Gray Duck Builders, LLC at 4225 Interlachen Trail, Sioux Falls, SD 57106:  On or about and at times prior to October 4, 2021, the employer did not ensure that employees were protected from falls while conducting framing operations on a residential property.  This condition exposed employees to fall hazards greater than 20 feet.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Gray Duck Builders, LLC at 4225 Interlachen Trail, Sioux Falls, SD 57106:  On or about and at times prior to October 4, 2021, the employer did not ensure that each employee engaged in framing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees were engaged in framing activities working from the top plates on a two story residential complex, without the use of a fall protection system. This condition exposed employees to fall hazards greater than 20 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a) The nature of fall hazards in the work area; b) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d) The role of each employee in the safety monitoring system when this system is used; e) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g) The role of employees in fall protection plans; h) The standards contained in this subpart.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  (a) Gray Duck Builders, LLC at 4225 Interlachen Trail, Sioux Falls, SD 57106:  On or about and at times prior to October 4, 2021, the employer did not ensure that employees were trained on the use of ladders being used on site regarding framing operations.  This condition exposed employees to fall hazards associated with the improper use of ladders.
