29 CFR 1910.22(d)(2): Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired. (a) On or about October 13, 2021, maintenance employees were exposed to the hazards of open plating tanks containing cyanide when they knelt or stood on a wooden scaffold plank laid over the tanks to change the air filters in the gold plating room.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. (a) The portable ladder used to access the scaffold plank on top of the cyanide tanks was not adequate in that the ladder was not tall enough to step directly over to the platform.
