29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.  (a)	All Peak Holdings, LLC DBA Allman Painting at 500 Village Road, Breckenridge, CO 80424:  On or before October 4, 2021, the creating and exposing employer did not ensure that employees were protected from injury, in that employees used extension ladders to access the balconies on the 2nd and 3rd level.  Employees then stood on the top railing on each balcony to paint overhead.  This condition exposed employees to fall hazards of approximately 40 and 30 feet to the ground below.

29 CFR 1926.1053(b)(1): A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet above the upper landing, or was not secured:  (a)	All Peak Holdings, LLC dba Allman Painting at 500 Village Road, Breckenridge, CO 80424:  On or before October 4, 2021, the creating and exposing employer did not ensure that extension ladders had side rails extending 3 feet above the top balcony rail or were secured when accessing 2nd and 3rd level balconies.  Employees exited extension ladders and climbed over balcony rails to access balconies.  In addition, employees climbed over balcony rails to access extension ladders.  This condition exposed employees to fall hazards of approximately 40 and 30 feet to the ground below.

29 CFR 1926.1060(a):  The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:  (a)	All Peak Holdings, LLC DBA Allman Painting at 500 Village Road, Breckenridge, CO 80424:  On or before October 4, 2021, the employer did not provide a training program for each employee using ladders to train each employee in the procedures to be followed to minimize hazards related to ladders, in that employees used extension ladders to access 2nd and 3rd level balconies.  Employees exited extension ladders and climbed over balcony rails to access balconies.  In addition, employees climbed over balcony rails to access extension ladders.  This condition exposed employees to fall hazards of approximately 40 and 30 feet to the ground below.  Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:  1.	The nature of fall hazards in the work area; 2.	The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; 3.	The proper construction, use, placement, and care in handling of all stairways and ladders; 4.	The maximum intended load-carrying capacities of ladders; and 5.	The standards contained in this subpart.
