29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) 6251 Canyon Woods Drive, BILLINGS, MT 59106: On or about October 5, 2021, and at times prior, employees were exposed to cave in hazards while moving water line in an unguarded trench measuring 5 feet 5 inches in depth. The competent person failed to remove employees from the excavation in a situation that could result in a cave in. Clear Creek Construction, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.651(k)(2), which was contained in OSHA inspection number 1435149, citation number 1, item number 1a and was affirmed as a final order on October 29, 2019, with respect to a workplace located at 2011 Lake Hills Drive, Billings, MT 59105.
