Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, , in that employees were not protected from frostbite and hypothermia injuries while working in a walk in freezer with an inoperable door release. a) Stock room area; On or about October 6, 2021, and times prior, employees were exposed to cold injuries, such as frostbite and hypothermia, when the safety button on the door of the walk-in freezer was inoperable, not allowing employees to exit the freezer if the door was completely closed.
