29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a. ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about September 30, 2021, the employer did not ensure that employees who accessed the upper level of the West Bench were protected from fall hazards.  An employee, working to unjam tubes from the West Bench trough, sustained injuries after falling approximately 54-inches to the lower level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.147(c)(4)(ii):The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to items of this section.   a. ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about September 30, 2021, the employer did not ensure that energy control procedures for the West Bench Push Pointer identified specific steps to follow to render the electrical, hydraulic, and pneumatic energy sources safe in that it lacked specific steps for shutting down and isolating energy sources, placement of lockout devices, and for verification of isolation.  Employees were exposed to crushing and struck-by injuries when unjamming and performing setup tasks.  b. ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about October 6, 2021, the employer did not ensure that energy control procedures for the West Bench Entry identified specific steps to follow to render the electrical and hydraulic energy sources safe in that it lacked specific steps for shutting down and isolating energy sources, placement of lockout devices, and for verification of isolation.  Employees were exposed to pinch point and struck-by injuries when setting up the die and mandrel.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about September 30, 2021, the employer did not ensure that employees who setup and maintained the West Bench were trained in the skills required for the safe application, usage, and removal of energy controls.  Employees who unjammed the equipment and setup the dies, gripper, and mandrel were not trained to isolate and/or render energy sources safe prior to performing servicing tasks.    ArcelorMittal Tubular Products USA LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.147(c)(7)(i), which was contained in OSHA inspection number 1212671, citation number 1, item number 1a and was affirmed as a final order on July 18, 2017, with respect to a workplace located at 686 W. Fairground St., Marion, OH 43302.

ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about September 30, 2021, employees were exposed to crushing and struck-by injuries in that the pushers, kickers, rollers, and tube ram on the upper table of the West Bench were not locked out prior to unjamming a tube from the trough.  The employer did not ensure that energy control application steps were implemented prior to removing a tube from the trough - the employer did not:  - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished.  b. ArcelorMittal Tubular Products USA LLC - Shelby, Ohio: On or about October 6, 2021, employees were exposed to pinch point and crushing injuries in that the West Bench Push Pointer was not locked out prior to performing gripper and pointer die changes.  The employer did not ensure that energy control application steps were implemented prior to the setup tasks - the employer did not:  - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished.  c.
