29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Production Line 5 - On or about September 30, 2021 and at times prior thereto, employees stand on the conveyor platform (4 feet, 2 inches from the ground) to pick up downed bottles. An employee fell from the platform on 9-30-21 resulting in a hospitalization due to a fractured skull.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: a) Production Line 5 - On or about September 30, 2021 and at times prior thereto, an employee fell from a platform fracturing his skull and resulting in a hospitalization. The employer did not report the hospitalization until October 5, 2022.
