OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about September 30, 2021, at 3120 North Andrews Avenue Extension, Pompano Beach, Florida, employees were exposed to the struck-by and runover hazards while walking/standing between a natural stone slab and the forklift while guiding the forklift operator during the movement the slab.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: On or about October 1, 2021, in the warehouse area at 3120 North Andrews Avenue Extension, Pompano Beach, Florida, employees were exposed to struck-by hazards when a powered industrial truck operator was driving a forklift without receiving refresher training after the operator had been involved n an accident.
