29 CFR  1926.602(c)(1)(ii):No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval..  a. On or about October 19, 2021, the employer used a Wacker EZ53 mini excavator to hoist an aluminum trench box into place by free-rigging chains hooked to the box directly to the teeth of the excavator's bucket. The unsecured and overloaded hoisting process was unapproved thereby exposing employees to a crushed-by hazard.
