29 CFR 1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a) Gary Emmett Construction, LLC at 115 8th Street West, Brookings, SD 57006: On or about and at times prior to October 7, 2021, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontracted employees were exposed to fall hazards as a result of conducting roofing activities without the use of a fall protection system, fall hazards associated with improper use of ladders, and lack of training. This condition exposed employees to a variety of hazards identified on site. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)Gary Emmett Construction, LLC at 115 8th Street West, Brookings, SD 57006: On or about and at times prior to October 7, 2021, the controlling employer did not ensure that subcontracted employees were protected from falls while conducting roofing operations on a residential property. This condition exposed employees to fall hazards greater than 10 feet.
