1926.95(c) Personal protective equipment was not of safe design and construction for the work to be performed:(a)(LOCATION)(SPECIFIC OPERATION(S) AND OR CONDITIONS) 29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about September 21, 2021 at the North 10th Street and York Street jobsite located in Manitowoc, Wisconsin; employee(s) working with pile driving operations were not provided with personal protective equipment that was designed for manually manipulating a pile into a lead.

29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees. On or about September 21, 2021 at the North 10th Street and York Street jobsite located in Manitowoc, Wisconsin; employees did not utilize high impact gloves when manually manipulating the pile into the lead exposing employees to caught between hazards.
