29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles:   a)  At 23438 Shadowridge Dr., Lot 157 Old Field, Daphne, Alabama:  On or about October 8, 2021 and at times prior; the employer allowed his employees to operate pneumatic nail guns without eye protection while installing shingles on the roof exposing his employees to struck-by hazards.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   a)  At 23438 Shadowridge Dr., Lot 157 Old Field, Daphne, Alabama:  On or about October 8, 2021 and at times prior; the employer allowed his employees to perform roofing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and pecting fall protection exposing his employees to a fall hazard of 9 feet 1 inch to the ground below.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 23438 Shadowridge Dr., Lot 157 Old Field, Daphne, Alabama:  On or about October 8, 2021 and at times prior; the employer allowed his employees to use  extension ladders to gain access to the roof and the rails of the ladders did not extend at least three feet above the roof landing to provide safe access exposing his employees to a fall hazard of up to 9 feet 1 inch to the ground below.
