29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a.) Living Coast North Mechanical Room - On or about October 8, 2021, the employer failed to ensure that employees who perform service and/or maintenance on the Train Air Handler Unit #3, participated in an annual periodic inspection of the energy control procedure, thereby exposing employees to the unexpected energization and/or startup of the equipment.

29 CFR  1910.147(c)(7)(i)(A):  Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation:  a.) Living Coast North Mechanical Room - On or about October 8, 2021, the employer failed to provide training to each authorized employee performing service and/or maintenance to machinery or equipment to ensure the employee acquired the knowledge and skills required for the safe application, usage and removal of energy control devices.  An employee sustained a left ring fingertip amputation while performing preventive maintenance on Trane Air Handler Unit #3.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):    a.) Living Coast North Mechanical Room - On or about October 8, 2021, an employee was exposed to machine hazards associated with moving parts while performing preventive maintenance on the Trane Air Handler Unit #3.  The employer failed to implement energy control application steps as the machine was not shut down or turn off to perform the servicing work [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.
