29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, Legacy Treatment Services located at 1289 Route 38 West in Hainesport, NJ 07724: On or about 10/13/2021 and thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
