(a) New residential construction; Lot 127; Top plate: On or about 10/12/2021, the employer exposed an employee who was conducting framing activities to struck-by hazards, in that he was operating a pneumatic Metabo NR83A5 3 1/4 inch strip nail gun at 140 PSI. The operating air pressure for this tool is between 70-120PSI.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction; Lot 189; roof: On or about 10/12/2021, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were installing shingles on a 10:12 pitched roof at heights measured at 17 feet 9 inches to the lower level.
