29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) New residential construction; Lot 508; Roof: On or about 10/12/2021, the employer exposed employees installing siding to struck-by hazards, in that they were operating a Metabo NT65M2(S) finishing nail gun at 40 PSI without eye protection. Safety glasses were not provided to employees prior to the beginning of the work day.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: (a) New residential construction; Lot 508; Front: On or about 10/12/2021, the employer exposed an employee installing siding to falls of 13 feet 3 inches to the lower level, in that a fall protection system was not provided to the employee while they were working from a ladder jack scaffold.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction; Lot 508; Roof: On or about 10/12/2021, the employer exposed an employee installing siding to fall hazards, in that a complete fall protection system was not provided to the employee when they were conducting siding installation activities on a 8:12 pitched roof at heights measured at 12 feet 2 inches to the lower level.
