29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) New residential construction; Lot 29; Roof:  On or about 10/12/2021, the employer exposed an employee installing siding to struck-by hazards, in that he was operating a Metabo MT65M2(S) 2-1/2 finish nail gun at 140 PSI  without eye protection. Safety glasses were not provided to the employee while conducting siding installation prior to the beginning of the work day.

29 CFR  1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded.  (a) New residential construction; Lot 29; Roof : On or about 10/12/2021, the employer exposed an employee conducting framing activities to struck-by hazards, in that he was operating a pneumatic Metabo MT65M2(S) 2-1/2 finish nail gun at 140 PSI. The safe operating air pressure for this tool is between 70-120 PSI.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction; Lot 29; Roof:  On or about 10/12/2021, the employer exposed an employee to fall hazards, in that a complete fall protection system was not provided to an employee who was conducting roofing activities on a 12:12 pitched-roof at heights measured at 10 feet 10-1/2 inches to the lower level.
