29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about October 13th, 2021, at 1950 W. 54th Street, Hialeah, Florida, employees were exposed to an approximate 40-foot fall hazard while walking near unprotected sides of a roof without a means of fall protection to gain access to another area of the roof to installing polymer-modified asphalt.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about October 13th, 2021, at 1950 W. 54th Street, Hialeah, Florida, the employer did not train employees to recognize and avoid the fall hazards present when, without using a means of fall protection, they were accessing a section of the roof to installing polymer-modified asphalt.
