29 CFR 1910.502(k)(1)(iii):Employers did not ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher, if compatible with the HVAC system(s): a) West Wichita Family Physicians, P.A. located at 8200 West Central Avenue, Wichita, Kansas 67212: On or about October 14, 2021, the employer failed to ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher in the COVID-19 Infusion Clinic. Before using the MERV 13, the employer was using air filters that were rated MERV 10.
