OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a crushing/caught between hazard while loading a ride-on zero turn mower into a trailer:  a) Equipment yard, 5875 Hulmeville Rd, - on October 14, 2021, an employee loaded an Exmark Lazer zero turn mower onto a trailer with two separate ramps set at an angle steeper than 15 degrees.   Among other feasible means of abatement would be to comply with the operators manual which states o page 27:  Loading a unit on a trailer or truck increases the possibility of backward tip-over. Backward tip-over could cause serious injury or death. *Use only a single, full width ramp; Do Not use individual ramps for each side of the unit. *If individual ramps must be used, use enough ramps to create an unbroken ramp surface wider than the unit. *Do Not exceed a 15� angle between ramp and ground or between ramp and trailer or truck. *Avoid sudden acceleration while driving unit up a ramp to avoid tipping backward.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a crushing/caught between hazard while operating a ride-on zero turn mower without the rollover protection system (ROPS) in place:  a) Equipment yard, 5875 Hulmeville Rd, - on October 14, 2021, an employee operated an Exmark Lazer zero turn mower with the ROPS bar in the down position while loading the mower on a trailer.   Among other feasible means of abatement would be to comply with the operators manual which states on page 9: There is no rollover protection when the roll bar is down.   *Keep the roll bar in the raised and locked position and use seat belt.  *Lower the roll bar only when absolutely necessary.  *Do Not wear seat belt when the roll bar is down.  *Drive slowly and carefully.  *Raise the roll bar as soon as clearance permits.
