29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on Lot #45 at 225 Dodd Lane, Alpharetta, GA 30009, Upper Roof: On or about 10/15/2021, the employer exposed employees to fall hazards of approximately 14-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in plywood sheathing installation. b) New residential construction located on Lot #45 at 225 Dodd Lane, Alpharetta, GA 30009, Lower Roof: On or about 10/15/2021, the employer exposed employees to fall hazards of approximately 10-feet, 11-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in plywood sheathing installation. c) New residential construction located on Lot #45 at 225 Dodd Lane, Alpharetta, GA 30009, Top of Roof Trusses: On or about 10/15/2021, the employer exposed employees to fall hazards of approximately 21-feet, 1-inch to the lower ground level, in that a fall protection system was not provided to employees engaged in roof truss installation.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS) New residential construction located on Lot #45 at 225 Dodd Lane, Alpharetta, GA 30009, First level ladder access to second level: On or about 10/15/2021, the employer exposed employees to fall hazards of approximately 11-feet, 9-inches to the lower level, in that the portable ladder side rails were not extended at least 3-feet past the second level landing to allow for safe access between levels.
