29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On October 15, 2021, at the above addressed jobsite, employees performing roofing work at a residential home, approximately 21 feet above the ground, were not provided personal fall arrest systems or other means of fall protection, thereby exposing the employee to fall hazards. No abatement certification or documentation is required for this item.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards: a) On October 15, 2021, employees were performing roofing work without being trained on the recognition of hazards and the use of fall protection systems. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
