29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): On or about October 6, 2021, the employer failed to implement a hazard communication program to all affected employees. Security employees were not explained the methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operating conditions and in foreseeable emergencies. Subcontractor employees were generating carbon monoxide and security employees were not made aware of the hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about October 6, 2021, the employer failed to train employees on the hazards of chemicals they may be exposed to or work with, including, but not limited to, propane and diesel fuel. Propane tanks and diesel fuel are used to power the forklifts, welders, and aerial lifts, and employees are exposed to fumes from combustion in the common work areas.

29 CFR 1926.35(e)(3): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and emergency's to control or eliminate any hazards or other exposures to illness or injury: On or about October 6, 2021, the employer did not instruct all covered employees in the recognition and avoidance of unsafe conditions. Security personnel were not instructed on the emergency action plan and informed of what to do in case of evacuation due to carbon monoxide alarms. The work site is an active construction site with building construction and process equipment installation.
