29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  29 CFR  1926.502(d)(15)(i): as part of a complete personal fall arrest system which maintains a safety factor of at least two.  a. On or before October 18, 2021 at a worksite located at 42722 State Route 7, Clarington, Ohio 43155 where employees were removing existing roofing materials, two employees' personal fall arrest systems were connected to a horizontal lifeline where the anchor was not installed per the manufactures' instructions, was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, and which did not maintain a safety factor of at least two. The horizontal lifeline was connected to a Temper Anchor which was installed sideways, thereby exposing the employees to a 38 foot fall hazard.  b. On or before October 18, 2021 at a worksite located at 42722 State Route 7, Clarington, Ohio 43155 where employees were removing existing roofing materials, two employees' personal fall arrest systems were connected to a horizontal lifeline where the anchor was not installed per the manufactures' instructions, was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, and which did not maintain a safety factor of at least two. The horizontal lifeline was connected to a cross arm strap which was installed around a roof vent, thereby exposing the employees to a 38 foot fall hazard.

29 CFR  1926.501(b)(10):"Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a. On or before October 18, 2021 at a worksite located at 42722 OH-7, Clarington, Ohio 43155 where employees were removing existing roofing materials, the employer failed to protect employees from falling. A roofer was not protected by guardrail systems, personal fall arrest system or a compliant warning line system. The attempted warning line system was not compliant in that the warning lines at the north east side of the opening were at or over the edge of the section being cut out. While two employees were cutting the existing decking, the unprotected worker stepped on the cut decking section when the decking gave way. The victim fell 38 feet, resulting in his death.

29 CFR  1926.502(g)(1)(i):When control lines are used, they shall be erected not less than 6 feet (1.8 m) nor more than 25 feet (7.7 m) from the unprotected or leading edge, except when erecting precast concrete members.  a. On or before October 18, 2021 at a worksite located at 42722 OH-7, Clarington, Ohio 43155 where employees were removing existing roofing materials, the employer failed to ensure the warning lines were at least 6 feet from the opening being removed: in that, the warning lines at the north east side of the opening were at or over the edge of the section being cut out. While two employees were cutting the existing decking, the victim stepped on the cut decking section when the decking gave way. The victim fell 38 feet, resulting in his death.
