29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: On the rooftop of a Chick-Fil-A drive through canopy, employees repairing an air conditioning unit at heights in excess of 6-feet and working less than two feet from the edge of the roof were not using any type of fall protection. This practice created a condition that exposed employees to a fall hazard greater than 6-feet to the pavement below.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: At Chick-Fil-A drive through, two employees were using 12-feet A-Frame stepladders to access an approximately 12-feet rooftop, which the stepladder was not designed for users to climb onto an upper landing surface. This practice created a condition that exposed the employees to fall hazards.
