29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about October 19, 2021, employees performing residential construction were observed at heights over 6 feet from the ground without any type of fall protection system. This condition exposed employees to fall hazards from heights of equal or greater than 6 feet from lower level. Gerardo Velasquez was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1301609, citation number 01, item number 01 and was affirmed as a final order on 05/15/2018, with respect to a workplace located at 2175 Enchanted Cress, El Paso, TX 79932.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about October 19, 2021, employees were not trained in the recognition of fall hazards while working on residential construction. This condition exposed employees to fall hazards equal or greater than 6 feet above lower level.
