29 CFR  1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a. At a temporary residential construction worksite, on the first story roof deck, with a  5:12 pitch, and the second story roof deck, with a 7:12 pitch, located at, or near, 179 Mosaic Boulevard, Lot 134 in Daytona Beach Florida:  On or about October 20, 2021, the employer exposed a carpentry employee to fall hazards ranging from 10 to 26-foot at the roof eaves, in that fall protection systems were not utilized to protect the employee, while installing roof sheathing boards.

29 CFR  1926.1052(c)(1)(ii):  Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a.     At a temporary residential construction worksite, on the interior staircase, located at, or near, 179 Mosaic Boulevard, Lot 134 in Daytona Beach Florida:  On or about October 20, 2021,  the employer exposed a carpentry employee to fall hazards ranging from 6 to 11-foot, in that fall protection systems, such as, but not limited to a stair railing systems (guardrails) were not utilized to protect the employee from the unprotected side of the staircase steps as the employee walked on the staircase.

29 CFR  1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.   At a temporary residential construction worksite, on the back slope of the first-story roof, located at, or near, 179 Mosaic Boulevard, Lot 134 in Daytona Beach Florida:  On or about October 20, 2021,  the employer exposed a carpentry employee to a fall hazard, in that a portable ladder did not extend 3 feet above the upper landing surface of the roof eaves, as the employee used the ladder to access the upper roof area.
