29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of 1926.501 (b):    a) 24 Village Drive, Southbridge, MA: On or about October 20, 2021 and at times prior an employee was observed working from the roof  approximately 9 feet above the lower level and the employee was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of 1926.501 (b).  VM General Contractor, Inc. was previously cited for the same violation of this occupational safety and health standard 29 CFR 1926.501 (b) (13), which is contained in OSHA inspection number 1340620 citation number 1, item number 3a  and was affirmed as a final order on 1/29/2019, with respect to a workplace located at 66 NH 25, Meredith, NH.  VM General Contractor, Inc. was previously cited for the same violation of this occupational safety and health standard 29 CFR 1926.501 (b) (13), which is contained in OSHA inspection number 1357204 citation number 1, item number 2b and was affirmed as a final order on 1/29/2019, with respect to a workplace located at 2 Palm Drive, Greenland, NH.

29 CFR 1926.1053(b)(1): Where portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:   a) 24 Village Drive, Southbridge, MA: On or about  October 20, 2021 and at times prior an employee was observed accessing the roof from an aluminum extension ladder that only extended 16 inches above the roof surface and the top of the ladder was not secured at its top and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  VM General Contractor, Inc. was previously cited for the same violation of this occupational safety and health standard 29 CFR 1926.1053 (b) (1), which is contained in OSHA inspection number 1357204 citation number 1, item number 2b and was affirmed as a final order on 1/29/2019, with respect to a workplace located at 2 Palm Drive, Greenland, NH.
