29 CFR 1910.29(a)(2): Provide and install all fall protection systems and falling object protection this subpart requires, and comply with the other requirements in this subpart before any employee begins work that necessitates fall or falling object protection. a) On or before 10/22/2021 the employer did not provided a fall protection system for employees who were expose to the hazards associated with an approximately 12' fall while performing such task as cleaning of the conveyor system. During the cleaning process employees would lay on their stomachs for approximately 132' of the 185' conveyor system.

29 CFR 1910.147(c)(1):Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a) On or before 10/22/2021 the employer did not establish an energy control program that included the use of specific procedures, employee training and periodic inspections to ensure that employees performing task such as but not limited to maintenance and cleaning understood how to secure power the energy sources to machines such as but not limited to; the potato chip conveyor system.

29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (1) authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (3) physically locate and operate the energy isolating devices in such a manner as to isolate the machine or equipment from the energy sources. (4) affix lockout or tagout devices to each energy isolating device (5) Prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergizing of the machine or equipment have been accomplished. a) On or before 10/22/21 the employer did not ensure that employee(s) working on the (approx. 185')conveyer system that employees laid down on their stomachs and ran through-out the facility were not locking out the electrical disconnect of 480 volts that powered the conveyor system prior to performing such task as cleaning the conveyer system.

29 CFR 1910.30(a)(1):(a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a) On or before 10/22/2021 the employer did not provide training that would ensure that employees working at heights of approximately 12' were protected from a fall hazard associated with employees cleaning the approximately 185 ' of conveyor system that moved the chips from processing to bagging area. The conveyor system was approximately 12' above a concrete floor.
