29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) On or about October 20, 2021, the employer, Bricker Wilson Construction Services, LLC, did not ensure that employees were protected from a cave-in in that a deviation from the speed shoring manufacturer's specification was made during the installation of speed shoring in a vertical-walled trench of approximately 8 feet in depth. Because the speed shoring hydraulic rams were placed too high on the trench walls, this allowed the trench collapse inward along the bottom section.

29 CFR  1926.651(k)(1):  An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:   a) On or about October 20, 2021, the employer, Bricker Wilson Construction Services, LLC, did not ensure that adequate inspections were conducted by a competent person of protective systems, excavations and adjacent areas in that shoring was not installed per specifications indicated on tabulated data and there was evidence of deep fatigue cracking of the parking lot asphalt immediately adjacent to the trench where excavated soil was placed.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) On or about October 20, 2021, the employer, Bricker Wilson Construction Services, LLC, did not ensure each employee was trained in the recognition and avoidance of unsafe working conditions when required to install a water line in a vertical-walled trench of approximately 8 feet in depth.  Employees had not been trained in the recognition of hazards when performing trench work.  In addition, employees had not been trained on the correct installation of hydraulic shoring.
