29 CFR 1910.134(f)(2): Employees using tight-fitting facepiece respirators were not annually fit tested: a) UMass Memorial Medical Center at 119 Belmont Street, Worcester, MA: On or about October 22, 2021 and at times prior, the employer did not perform an annual fit test on all employees required to wear respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus during safety, security and law enforcement duties, while exposed to suspected and confirmed positive COVID-19 patients.

29 CFR 1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that comes between the sealing surface of the facepiece and the face or that interfered with valve function: a) UMass Memorial Medical Center at 119 Belmont Street, Worcester, MA: On or about December 9, 2021, and at times prior, the employer permitted employees who had facial hair that comes between the sealing surface of the facepiece and the face to wear N95 filtering facepiece respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus during safety, security and law enforcement duties, while exposed to suspected and confirmed positive COVID-19 patients.
