29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance. This includes, but not limited to the following: A)A specific statement of the intended use of the procedure B)Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy. C)Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them. D)Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. (a)DeSCo Architectural, Inc. at 716 3rd Street SE, De Smet, SD 57231: On or about and at times prior to October 22, 2021, the employer did not establish a program consisting of specific energy control procedures to control hazardous energy exposure on multiple energy source pieces of equipment including the Wegoma double miter saw, Wegoma crimper, Hy Pnew Mat auto drill, Wegoma milling machines among other machines. This condition exposed multiple employees to crushing, amputation shock and air embolisms while maintaining equipment.

29 CFR 1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: (a)DeSCo Architectural, Inc. at 716 3rd Street SE, De Smet, SD 57231: On or about and at times prior to October 22, 2021, the employer did not ensure an inspection program was established and executed at least annually that ensured the program elements were being followed and inadequacies were identified. This condition exposed employees to amputation, crushing and shock hazards associated with an improperly locked out piece of equipment.

This condition exposed 26 employees to potential crushing, amputation and shock hazards. Including but not limited to the following: (1)CNC Mills; (2)Punch Presses; (3)Plunge Saw Table; (4)CNC Fabrication Equipment

29 CFR 1910.242(b):Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.: (a)DeSCo Architectural, Inc. at 716 3rd Street SE, De Smet, SD 57231: On or about and at times prior to October 22, 2021, the employer failed to ensure that compressed air nozzles used for cleaning were regulated so as not to exceed 30 p.s.i. Employees regularly use compressed air to clean off working surfaces of equipment as well as general maintenance cleaning. This condition exposes employees to pulmonary embolism and eye injuries from flying debris.
