29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. A sorter at the Centurion baler was exposed to continuous noise at 67% of the daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 87.1 dBA during the 453 minute sampling period on October 28, 2021; exposure calculations included a zero increment for the 27 minutes not sampled. b. A picker in the Titech facility was exposed to continuous noise at 84.3% of the daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 88.7 dBA during the 449 minute sampling period on October 28, 2021; exposure calculations included a zero increment for the 31 minutes not sampled. c. A forklift driver in the Titech facility was exposed to continuous noise at 107.9% of the daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 90.5 dBA during the 445 minute sampling period on October 28, 2021; exposure calculations included a zero increment for the 35 minutes not sampled. d. A general laborer in the Titech facility was exposed to continuous noise at 133.8% of the daily noise exposure (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 92.1 dBA during the 459 minute sampling period on October 28, 2021; exposure calculations included a zero increment for the 21 minutes not sampled.

On or about October 26, 2021, in the Titech facility, employees were exposed to caught-in hazards when accessible return idlers on the inclined portion of the picking conveyor belt were not guarded to protect employees from their ingoing nip points. d. On or about October 26, 2021, in the Titech facility, employees were exposed to caught-in hazards when accessible return idlers on the inclined portion of the Titech fines conveyor belt were not guarded to protect employees from their ingoing nip points. e. On or about October 26, 2021, in the Titech facility, employees were exposed to caught-in hazards when the PR24 conveyor was not guarded to protect employees from ingoing nip points of the tail pulley.
