29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Emiliano Barrera DBA Emiliano Construction LLC located at 443 Mainsail Drive, Westerville, OH 43081: On and Preceding October 27, 2021, the employer did not ensure that portable ladders used for access to an upper landing surface had side rails extend at least 3 feet above the upper landing surface being accessed. Two of three extension ladders being used for access to the roof of a two story residential home were positioned with the side rails extended less than 20 inches beyond the upper landing. The following condition exposed employees to falls up to 19 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Emiliano Barrera DBA Emiliano Construction LLC located at 443 Mainsail Drive, Westerville, OH 43081: On and preceding October 27, 2021, employees were performing re-roofing work without fall protection, thereby exposed to a fall hazards ranging from 10-25 feet. Emiliano Barrera was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1502073, citation number 1 item number 2 and was affirmed as a final order on June 14, 2021, with respect to a workplace located at 338 Linden Circle, Pickerington, OH 43147.
