29 CFR  1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.   a) 2801 North T Street, Pensacola FL; On October 26, 2021, and at times prior, while conducting land clearing activities, the employer exposed employees to struck-by hazards and crushed-by hazards in that employees were allowed to operate a John Deer 650J LGP Crawler Dozer without using the seat belt provided by the manufacturer.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person certifying that the evaluation had been performed; and the date(s) of the hazard assessment.  a) 2801 North T Street, Pensacola FL; On October 26, 2021, and at times prior, the employer failed to perform a workplace assessment to determine the hazards, and the necessary personal protective equipment required for the task such as but not limited to, seat belts, safety glasses, safety shoes, hearing protection, and gloves.
