29 CFR  1926.1051(a):A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.  The employer does not provide a stairway, ladder, ramp, etc., for the personnel points of access where there is a break in the elevation greater than 19 inches.  This most recently occurred on October 27, 2021, at a construction site located at 6753 State Road, Parma, Ohio.  Employees were exposed to fall hazards of approximately 39 inches while traversing between an upper and lower roof while removing and installing roofing material on a commercial building.  To abate this hazard in the future, the employer must ensure employees are provided with a stairway, ladder, ramp, etc., for all points of access where there is a break in elevation greater than 19 inches.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.

29 CFR  1926.501(b)(11):"Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  The employer does not protect each employee from fall hazards while performing roofing work activities on steep roofs with unprotected sides and edges at heights of 10 feet or greater above the ground, by the use of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on October 27, 2021, at a construction site located at 6753 State Road, Parma, Ohio.  Employees were exposed to fall hazards of 10 feet or greater from the roof to the ground while removing and installing roofing material on a commercial building with roof pitches of 6 in 12 and 5 in 12.  Employees were not protected from fall hazards by the use of a guardrail systems, safety net systems, and/or personal fall arrest systems.  To abate this hazard in the future, the employer must ensure employees are provided with, and required to use, fall protection in accordance with this standard, and that no employees are permitted to work from elevations six (6) feet of greater without being provided fall protection systems or devices.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.  ILS Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) fall protection residential construction) which was contained in OSHA inspection number 1501432, citation number 02, item number 02 and was affirmed as a final order on 3/23/2021 with a work location of 173 Applegrove St NE, Canton, Ohio.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer does not provide a training program or train each employee who is exposed to fall hazards while performing roofing work to recognize the hazards of falling and the procedures to minimize those hazards.  This most recently occurred on October 27, 2021, at a construction site located at 6753 State Road, Parma, Ohio.  Employees were exposed to fall hazards of 10 feet or greater from the roof to the ground while removing and installing roofing material on a commercial building.  To abate this hazard in the future, the employer must ensure employees are provided with a fall hazard training program that enables each employee to recognize fall hazards and the procedures to minimize fall hazards in accordance with this standard, and that no employees are permitted to work from elevations six (6) feet of greater without being provided fall protection systems or devices.
