29 CFR 1910.132(a): The employer failed to provide and maintain protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about October 28, 2021 Marion Logistics Services at 3007 Harding Highway East in Marion, Ohio did not provide aprons for the operation of adding water to the lead-acid batteries that power the forklift. The employer provides other personal protective equipment (PPE) for the same operation including gloves, face shields, and goggles to employees and the PPE is placed on a nearby wall where employees have access to the PPE at all times.

29 CFR 1910.151(c): The employer failed to provide suitable facilities for quick drenching or flushing of the eyes and body for immediate emergency use in the work area where the eyes or body of any person may be exposed to injurious corrosive materials. On or about October 28, 2021, Marion Logistics Services at 3007 Harding Highway East in Marion, Ohio did not provide employees the use of suitable facilities such as an eyewash station or a safety shower in the immediate area for the operation of filling the lead-acid batteries that power the electric forklifts used in the workplace. The lead-acid batteries contain sulfuric acid that has a pH value of less than or equal to 2 and employees are exposed to the chemical during the refilling or addition of water to the battery.
