29 CFR 1910.180(h)(1)(i): No crane shall be loaded beyond the rated load, except for test purposes as provided in paragraph (e) of this section. a) Jobsite 1 Castine Street, Worcester, MA on or about October 28, 2021 and at times prior, the employer did not ensure lifted loads were kept within the cranes safe working load chart exposing employees to hazards resulting from failure and or collapse of the crane, its load and or its boom structure. On October 28, 2021 and at times prior, an employee operating a National Crane model NBT 45-1 did not follow the manufacturers safety instructions or follow the crane manufacturers Load Charts and proceeded to lifted loads in excess of the cranes rated capacities, ultimately resulting in the cranes collapse and loss of control of the suspended load.

29 CFR 1910.180(h)(3)(ix)(c): Outriggers shall be used when the load to be handled at that particular radius exceeds the rated load without outriggers as given by the manufacturer for that crane. Where floats are used they shall be securely attached to the outriggers. Wood blocks used to support outriggers shall be of sufficient width and length to prevent shifting or toppling under load. a) Jobsite 1 Castine Street, Worcester, MA on or about October 28, 2021, The employer had not ensured that outrigger floats for the National Crane model NBT 45-1 were securely attached to the outriggers and that wood blocks used were of sufficient width and length to prevent shifting or toppling under load. The city the jobsite was located in had received several inches of rain the day before the accident and the crane was setup on a grass covered lawn. The outriggers were deployed with the floats but no or insufficient wood blocks were utilized to under the front passenger outrigger to ensure the setup area was capable of supporting the intended load.
