29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) New residential construction; Lot 12; Second floor: On or about 10/13/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second floor top plate of a new residential construction building. Employees were exposed to fall hazards at heights measured at 19 feet 5-1/2 inches to the lower level.

29 CFR 1926.1053(b)(13):The top or step of a stepladder was used as a step: (a) New residential construction; Lot 12; First floor to second floor: On or about 10/13/2021, and at times prior, the employer exposed an employee engaged in framing work to fall hazards of 6 feet in that the employee was using the top cap of a 6-foot A-frame ladder to gain access from the lower level to the second floor.
