29 CFR 1926.451(b)(3): The front edge of scaffold platforms was more than 14 inches (36 cm) from the face of the work, and guardrail systems were not erected along the front edge and/or personal fall arrest systems were not used in accordance with paragraph (g) of this section to protect employees from falling. Site: 289 3rd Ave in Brooklyn, NY. a) On or about 11/1/2021, employees were working on the roof of the building and used three-story supported scaffold to access and egress the area. Employees were exposed to falling approximately 20 feet through a gap between the building and the scaffold platform located on the 3rd floor level. The employer did not install fall protection systems to protect the employees from falling to lower levels.

29 CFR 1926.454(c)(1): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer did not retrain each such employee so that the requisite proficiency is regained. Site: 289 3rd Ave in Brooklyn, NY. a) On or about 11/1/2021, employees used a three-story supported scaffold for access and egress from the roof area. The employees lacked the understanding for safe use of the scaffold, and lacked the proficiency to recognize the fall hazard presented by the gap between the building and the scaffold platform. The employer did not retrain the employees so that the requisite proficiency is regained. An employee fell 20 feet through a gap between the building and the scaffolding resulting in fatal injuries.

The A-Frame ladder leaned against the building wall and was closed. Employees used the ladder to access and egress the roof area. The employer did not provide retraining for each employee as required, so that the employee maintains the understanding and knowledge to recognize hazards associated with ladder use.
