29 CFR 1926.252(a):An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building: New townhome construction located on Lot #27 at 302 Concord Street, Alpharetta, GA 30009, Third level/Roof: On or about 11/03/2021, the employer exposed employees to struck-by hazards while throwing siding debris at heights over 25-feet to the lower level from the roof, in that a garbage chute or similar enclosed slide was not provided while throwing debris into a red garbage bin located on ground level as employees worked in close proximity to the bin.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: New townhome construction located on Lot #27 at 302 Concord Street, Alpharetta, GA 30009, Third level/Roof: On or about 11/03/2021, the employer exposed employees to fall hazards while throwing siding debris at heights over 25-feet to the lower level from the roof, in that a fall protection system was not provided to employees using the roof as a walking/working surface to remove debris from the upper level of the townhome.
