29 CFR  1910.28(b)(3)(i):The employer did not ensure each employee was protected from falling through any hole (including skylights) that was 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems.  On or about November 2, 2021, and times prior thereto,  at the Georgia-Pacific Wood Products in Pineland, Texas,  employees used catwalks with deficient grading to access the crane cab.

OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to:  a) On or about November 2, 2021, and times prior thereto, at the Georgia-Pacific Wood Products in Pineland, Texas, the employer failed to ensure that the JC40 La Tourneau Pedestal Crane had received frequent and periodic inspections which would have led to the discovery of deficiencies such as but not limited, live electrical wiring in cab, an inoperable Emergency stop switch device, a missing mounted fire extinguisher, a missing inner door handle and an inoperable wind indicator.  b) On or about November 2, 2021, and times prior thereto, at the Georgia-Pacific Wood Products in Pineland, Texas where crane operators were operating a JC40 La Tourneau Pedestal crane to lift timber without an operating load limit switch sensor.  c) On or about November 2, 2021, and times prior thereto, at the Georgia-Pacific Wood Products in Pineland, Texas where employees were required to operate without having a load test conducted on the crane to ensure its lifting capacity following modifications made to the crane.
