29 CFR 1926.102(a)(1):Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: a) Timberbrooke; Lot 188: On or about 10/22/2021, and at times prior, the employer exposed an employee to struck-by hazards, in that he was operating a Metabo HPT nail gun without eye protection while performing siding activities.

29 CFR 1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded. a) Timberbrooke; Lot 188: On or about 10/22/2021, and at times prior, the employer exposed an employee who was performing roofing activities to struck-by hazards, in that he was operating a Metabo pneumatic nail gun with the pressure at 140 psi. This was above the 120 psi maximum range of the nail gun.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Timberbrooke; Lot 188: On or about 10/22/2021, the employer exposed an employee to a fall hazard of more than 25 feet above ground level, in that a fall protection system was not provided while employees were on a 10:12 pitch roof framing a residential home.
