29 CFR 1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded. a) Retreat at Sierra; Lot 182: On or about 10/20/2021, and at times prior, the employer exposed employees to struck-by hazards, in that they were operating Hitachi pneumatic nail gun(s) at 130 psi while performing framing activities. This was above the 120 psi above the maximum nail gun operating specification.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Retreat at Sierra; Lot 182: On or about 10/20/2021, the employer exposed an employee to a fall hazard of more than 25 feet above ground level, in that a fall protection system was not provided while employees were on a 10:12 pitch roof framing a residential home.
