29 CFR 1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded. a) Retreat at Sierra; Lot 108: On or about 10/20/2021, and at times prior, the employer exposed an employee to struck-by hazards, in that he was operating a Hitachi pneumatic nail gun at 200 psi while performing framing activities. This was over the 120 psi maximum operating pressure for the nail gun.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Retreat at Sierra; Lot108: On or about 10/20/2021, the employer exposed an employee to a fall hazard of approximately 19 feet above ground level, in that a fall protection system was not provided while employees were on a 10:12 pitch roof framing a residential home.
