29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Hamon Infrastructure Inc., at Holly Street and E. Eastman Avenue, Denver, CO: On or about 10/29/2021 and 11/1/2021, the employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to excavations to control or eliminate any hazards or other exposure to illness or injury. Employees were directed to enter an approximate 7.3 foot deep excavation to work on concrete drains and manholes. The excavation possessed vertical earthen walls, consisted of Type B soil, water seepage was present, and protective systems were not in place. The employees at the worksite had not received effective training regarding excavation hazards or the use or limitations of protective systems. This condition exposed employees to a cave-in hazard.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Hamon Infrastructure Inc., at Holly Street and E. Eastman Avenue, Denver, CO: On or about 10/29/2021 and 11/1/2021, the employer did not ensure that an inspection of the excavation and the adjacent area was conducted by a competent person prior to the start of work and as needed throughout the shift. Employees were directed to enter an approximate 7.3 foot deep excavation to work on concrete drains and manholes. The excavation possessed vertical earthen walls, consisted of Type B soil, water seepage was present, and protective systems were not in place. A competent person did not inspect the excavation prior to entry into the excavation by the employees. This condition exposed the employees to a cave-in hazard.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Hamon Infrastructure Inc., at Holly Street and E. Eastman Avenue, Denver, CO: On or about 10/29/2021 and 11/1/2021, the employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system. Employees were directed to enter an approximate 7.3 foot deep excavation to work on concrete drains and manholes. The excavation possessed vertical earthen walls, consisted of Type B soil, and water seepage was present. Concrete jersey barriers were positioned at the perimeter of the excavation. Employees accessed the excavation from the west earthen vertical wall and traveled through the excavation. Employees worked in proximity to the east earthen vertical wall. Protective systems were not used. This condition exposed the employees to a cave-in hazard.
