29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):   Phase 4, Production Line 16 - On or about October 30, 2021, authorized employees performed servicing and maintenance tasks on the RP-16 Kliklok Vari- Straight Topload Carton Closer, serial no. VS-192/A0338. The employer's Lockout Tagout Procedure (MSP-RP16) did not list specific procedural steps for shutting down the equipment, thereby exposing employees to caught-in, electrical, and pneumatic hazards during servicing and maintenance activities.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a) Phase 4, Production Line 16 - On or about October 30, 2021, employees were exposed to machine hazards associated with moving parts and in-going nip points while servicing and maintaining the RP-16 Kliklok Vari-Straight Topload Carton Closer, serial no. VS-192/A0338.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR  1910.147(f)(3)(i): A procedure was not utilized to afford the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device when servicing and/or maintenance was performed by a crew, craft, department or other group:    a) Phase 4, Production Line 16 - On or about October 30, 2021, the employer failed to ensure that a procedure was utilized to afford the Changeover and Maintenance Mechanics a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device when servicing and maintenance was performed by both employees on the RP-16 Kliklok Vari-Straight Topload Carton Closer, serial no. VS-198/A0338. The employees were exposed to machine hazards associated with moving parts and in-going nip points.  The employees performing the work did not use group lockout.

29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a) Phase 4, Production Line 16 - On or about October 30, 2021, authorized employees were required to perform service and maintenance on the RP-16 Kliklok Vari-Straight Topload Carton Closer, serial no. VS-192/A0338.  The employer did not ensure a periodic inspection of the energy control procedure was performed at least annually as required by the standard, thereby exposing employees to machine hazards associated with moving parts and in-going nip points.  Hearthside Food Solutions, LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1910.147(c)(6)(i), which was contained in OSHA inspection number 1279569, citation number 1, item number 2 and was affirmed as a final order on May 14, 2018, with respect to a workplace located at 775 State Rt 251 in Wenona, IL 61377.  Hearthside USA - CPG Partners, LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR  1910.147(c)(6)(i), which was contained in OSHA inspection number 1421304, citation number 1, item number 1 and was affirmed as a final order on February 25, 2020, with respect to a workplace located at 1220 Meacham Rd. in Itasca, IL 60143.
